I am considering divorce, what is my next step?

Anyone considering a divorce should consult a qualified divorce attorney to be aware of all his or her legal options. In order to get divorced in the state of Florida, you (or your spouse) must be a resident of the state for at least six months prior to filing the petition for divorce. Florida is a “no-fault” state, meaning that neither spouse needs to put forward any reasons for the divorce but only state that the marriage is “irretrievably broken” (meaning there is nothing that can be done to put the marriage back together).

Florida Divorce Laws

If the requirements above are met, you will need to decide what kind of divorce needs to be filed; regular or simplified. A simplified divorce is appropriate when there are no minor children born of the marriage, the spouses are in agreement as to the division of assets and liabilities, and both are willing to participate in the dissolution of marriage process.

If these items are not applicable to your case, you need to file a regular dissolution of marriage petition. A local divorce lawyer can help you decide which divorce process is the right option and prepare all the necessary documents to initiate the divorce proceedings.

I am not sure what assets and liabilities we have. How will I know what is a fair settlement?

A knowledgeable Aventura divorce lawyer can educate you regarding your options when it comes to discovery (obtaining additional information/evidence) in your divorce case. In every divorce case in the state of Florida the parties must file a financial affidavit and exchange minimal financial documents (called mandatory disclosure).

Separation agreement

Your attorney will review the financial disclosure of your spouse and will advise you whether it is necessary to request additional documents from your spouse. Your divorce attorney might also advise you that it may be helpful to retain the services of a forensic accountant to properly ascertain your spouse’s income (if the spouse is self-employed) or to differentiate between marital and non-marital assets.

How is the divorce process different if minor children are involved?

If the parties have minor children born of the marriage, both parties must take a parenting class and submit the certificate to the court before the divorce can be finalized. The parents must also come up with a parenting plan which spells out how the parties will share the responsibilities regarding the child and how they will split the time with the child.

This is often one of the most difficult parts of the divorce, and requires a very sensitive and compassionate approach. Attending mediation with a knowledgeable divorce lawyer and a qualified mediator often helps the couple to reach a compromise on the parenting plan that is in the best interest of the children.
