According to divorce attorney Sue Moss, who spoke to PEOPLE, a divorce may result in a drawn-out legal battle: “Now, with a possible divorce on the horizon, the couple — who share son Benjamin Rein, 12, and Vivian, 9, along with Brady’s 15-year-old son John Edward, whom he shares with ex Bridget Moynahan — may likely squabble over the division of their multimillion-dollar assets.”
“The big challenge for him is everything will be determined at the height of his income because to get him to come back, the Tampa Bay Buccaneers had to come up with a lot of cash — and that is the baseline for determining the support in this case,” Moss says.
Attorney Sue Moss told People that when Gisele began her modeling career, she made more money than her husband, Tom Brady. But as he went on to win more games and earn more money, his earnings eventually outpaced hers. As a result, and because of the timing, the case will be determined based on the height of earnings.
Assuming that Gisele Bündchen and Tom Brady have a prenuptial agreement in place, their net worth will be determined by what is outlined in the agreement. If they do not have a prenuptial agreement, their net worth will be determined by their assets and liabilities at the time of divorce.
